Tangium.com is operated by Everpeaks LLC (“we”, “us”, “our”).
By placing an order, you agree to these terms.

1. What this is

We coordinate physical outbound campaigns through third-party production and logistics providers.

You provide the design, message, and recipient list. We route it for production and delivery into corporate environments. Campaigns include QR codes that link to content you control.

2. Three things we do not sugarcoat

2.1 Data Responsibility: The production and shipping uses the exact mailing list your team provides. Because physical materials and logistics are committed instantly, we cannot verify, validate, or fix incorrect data. If a package goes to an old corporate headquarters or a remote employee's outdated address based on your list, the order is considered fulfilled.

2.2 Recipient Acceptance: Some enterprise mailrooms and corporate security desks have strict, shifting protocols. While our custom packaging is built to maximize delivery success, a recipient can refuse a delivery, a gatekeeper can discard it, or a corporate gift policy can block it. If an office turns the package away at the door or a QR code goes unscanned, the logistics cycle is still considered complete.

2.3 Production Finality: Every item is custom-rendered and queued for production the moment your campaign locks. Because physical materials, labor, and logistics are spent immediately, we do not offer refunds, modifications, or cancellations for buyer's remorse, bad target data, ghosted replies, or campaign performance. All submissions are final.

3. What we actually do

We coordinate the production and delivery of physical items based strictly on your instructions.

We use third-party manufacturing partners and commercial carriers to handle production, assembly, and final delivery. These partners are independent contractors, not our employees or legal agents.

Delivery is contractually complete when the commercial carrier marks the item as delivered, or records a delivery refusal at the destination address. We are not liable for transit delays, carrier strikes, weather disruptions, or manufacturing defects caused by these independent third parties.

4. QR codes and digital content

Physical assets include QR codes. You provide a destination URL (such as a recorded video, landing page, or CTA), and we turn that into a QR code, add it to your asset, and send it for production.

We provide digital routing purely as a discretionary convenience; we have no obligation to maintain QR routing uptime and provide zero service level guarantees. We do not host, review, monitor, or maintain any linked content.

You are solely responsible for what those links display, whether they work correctly, and any legal or compliance issues arising from them.

We reserve the right to disable, redirect, or terminate any QR link instantly, at any time, without notice, and without liability, at our sole discretion. Disabling a link under this section does not entitle you to a refund, nor does it alter the completed status of your physical order.

5. No performance guarantees

Our designs and service are created to help you create a pattern interrupt and open doors in key accounts, but we do not guarantee any outcomes, including replies, meetings, sales, conversions, pipeline impact, engagement, or QR scans. You are paying for physical production routing and carrier dispatch only.

You acknowledge that you are not relying on any advice, marketing claims, ROI projections, or performance expectations from us when placing your order. You are buying execution, not guaranteed sales outcomes.

6. Fulfillment, refunds, and refusal of service

We reserve the right to refuse service, reject a campaign, or cancel any order at any time, for any reason, at our sole discretion.

All submitted orders are final. Once an order is placed and paid, it cannot be modified or cancelled. Because our systems route orders via automated API immediately upon submission, there is zero cancellation window.

Our operational obligations are fully satisfied the moment your items are routed, produced, and handed off to the commercial carrier. For the purposes of payment processing, marketing dissatisfaction, low response rates, or carrier transit issues do not constitute non-delivery and are contractually agreed not to be grounds for a payment dispute, chargeback, or reversal request.

We do not offer refunds for:

sending to the wrong address or incorrect targeting data supplied by you
a recipient, building, or mailroom refusing to accept the item
items that are returned to sender
items that are marked delivered by the carrier but not picked up by the recipient
lack of response or engagement
customer change of mind
campaigns rejected or paused due to a violation of these terms

7. Your responsibility for data and content

You are fully responsible for the legality of your campaign, messaging, designs, and targeting.

If you upload your own designs, you are fully responsible for owning the intellectual property rights to use, print, and distribute those designs. You confirm you have the legal right to use and share all data you upload. You guarantee that your recipient lists were compiled lawfully and do not rely on unlawfully scraped, stolen, or purchased data.

You must not use this service for illegal, deceptive, harassing, or impersonation-based activity. You warrant that your true identity is clearly and conspicuously disclosed within the physical asset or the destination page. We assume zero duty to audit, verify, or police your messaging identity.

8. Limitation of liability

To the maximum extent permitted by law, Everpeaks LLC is not liable for lost revenue, lost profits, failed campaigns, missed opportunities, delivery failures caused by third-party carriers, incorrect customer data, or recipient behavior.

Our total, maximum aggregate liability for any mistake, error, production defect, or delivery failure—no matter the cause or legal theory—is strictly limited to the exact dollar amount you paid us for that specific order.

9. Indemnification

If your campaign, uploaded data, designs, or QR-linked content leads to a claim, dispute, fine, or legal action against us by a recipient, brand, regulator, or third party, you agree to fully defend and indemnify us.

Except in cases resulting solely from our own gross negligence, you agree to cover all related costs, including our legal fees, defense costs, settlements, and damages. We retain absolute control over our legal defense—including choosing our own attorneys and approving any settlements— and you agree to fully cooperate with our defense at your expense. This obligation survives any termination of these terms.

10. Service changes

We may modify or stop any part of the service infrastructure at any time without notice or liability.

11. Governing law

These terms are governed by the laws of the State of Wyoming, United States. Any disputes will be handled exclusively in courts located in Sheridan, Wyoming.
